Terms of Service

These are the rules of the road for using Sodaroad. Nothing unusual here — just the standard stuff that keeps things fair for everyone. By using the service, you're agreeing to what's outlined below.

1. Acceptance of Terms

By accessing or using Sodaroad ("the Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree to these Terms or the Privacy Policy, you may not use the Service. These Terms apply to all users, visitors, and any person who accesses or uses Sodaroad in any capacity.

2. Description of Service

Sodaroad is an email application — an inbox on top of Gmail. The Service connects through the Gmail API, imports your mail — everything except spam, trash, and drafts, starting from your 10,000 most recent messages — into an encrypted store that the Service renders, keeps that store in sync as your mail changes, and sends the mail you compose through Gmail's API from your Google account. The Service does not alter your Gmail beyond mail you send from it: your read/unread and archived state in Sodaroad is kept in Sodaroad and not written back to Gmail. (An optional automatic-triage feature — off today — can archive bulk promotions in Gmail by removing Gmail's Inbox label; it is disclosed before it is ever turned on.) Sodaroad also offers an optional memory feature: with your explicit consent, it sends the text of your conversations to a named AI model provider — verified not to train its models on your content — to extract decisions and commitments, as described in our Privacy Policy and at the memory consent page; the feature stays off until you turn it on there.

3. Your Account

You must authenticate through Google OAuth to create an account. You are responsible for maintaining the security of your account and for all activity that occurs under it. You agree to provide accurate information and to notify us immediately at hello@matome.ai if you suspect any unauthorized use of your account. You may only create one account per email address.

4. Email Access & Consent

To provide the Service, Sodaroad requires access to the content of your emails through the Gmail API. By connecting your Google account, you explicitly consent to Sodaroad accessing, reading, processing, storing, and analyzing your email content — including sender information, subject lines, message bodies, headers, and metadata — to show your inbox, render your conversations, keep your stored copy in sync, and send mail you compose. Sodaroad stores an encrypted copy of the mail it reads (bodies and previews encrypted with AES-256-GCM), sets up a Gmail watch (a push subscription on your mailbox) to learn about new mail, and you can delete everything Sodaroad has stored at any time from your account settings.

Sodaroad uses machine learning to improve the accuracy of classification for your account. Any machine learning applied to your email data is personalized to your account only. Your email data is not co-mingled with other users' data and is not used to train generalized, foundational, or non-personalized AI or ML models.

You may revoke this access at any time through your Google Account permissions or by contacting us. Revoking access will immediately stop Sodaroad from accessing your emails. 5. Google API Compliance

Sodaroad's use of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements. Your Google user data is used only to provide and improve user-facing features that are prominent in Sodaroad's interface. We do not use Google user data for advertising, and we do not transfer it to third parties except as described in our Privacy Policy.

6. Acceptable Use

You agree not to: (a) misuse the Service or interfere with its operation; (b) reverse-engineer, decompile, or disassemble any part of the Service; (c) attempt to access the Service through any method other than the interfaces we provide; (d) use the Service for any purpose that is unlawful or prohibited by these Terms; (e) use the Service in violation of any applicable local, state, national, or international law or regulation; (f) use automated scripts, bots, or other means to create multiple accounts or to abuse the Service; or (g) attempt to probe, scan, or test the vulnerability of the Service or circumvent any security mechanisms. Good-faith security research conducted under our published disclosure policy is welcome and is not a violation of this section.

7. Intellectual Property

The Sodaroad service, including its software, algorithms, machine learning models, user interface design, branding, logos, and content, is owned by Sodaroad and protected by applicable intellectual property laws, including copyright, trademark, and trade secret law. You may not copy, modify, distribute, sell, lease, sublicense, or create derivative works based on any part of the Service without prior written permission from Sodaroad. All rights not expressly granted herein are reserved.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. SODAROAD DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT ALL NEWSLETTER EMAILS WILL BE CORRECTLY IDENTIFIED, CLASSIFIED, OR SUMMARIZED. SODAROAD MAKES NO WARRANTY REGARDING THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY CONTENT OR INFORMATION OBTAINED THROUGH THE SERVICE.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SODAROAD AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOST PROFITS, LOSS OF GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE) AND EVEN IF SODAROAD HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100).

10. Indemnification

You agree to indemnify, defend, and hold harmless Sodaroad, its affiliates, and their respective officers, directors, employees, agents, and licensors from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of or access to the Service; (b) your violation of these Terms; (c) your violation of any rights of a third party; or (d) any content or data you transmit through the Service.

11. Termination

We reserve the right to suspend or terminate your access to Sodaroad at any time, with or without cause and with or without notice, including for any violation of these Terms. You may terminate your account at any time from the in-app account controls, by emailing hello@matome.ai, or by revoking access through your Google Account permissions. Upon termination: (a) your right to use the Service ceases immediately; (b) we will stop accessing your email data; and (c) your data will be handled in accordance with our Privacy Policy, including the immediate-deletion process described there. Sections 7 through 10, 12, and 13 shall survive any termination of these Terms.

12. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in the State of Delaware, and you consent to the personal jurisdiction of such courts. You agree that any claim must be brought within one (1) year after the cause of action arises, or such claim shall be permanently barred.

13. General Provisions

Entire Agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Sodaroad with respect to the Service and supersede all prior or contemporaneous agreements, representations, and understandings.

Severability. If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

Waiver. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

Assignment. You may not assign or transfer these Terms or your rights hereunder without our prior written consent. Sodaroad may assign these Terms without restriction, including in connection with a merger, acquisition, or sale of assets.

14. Changes to These Terms

We may revise these Terms at any time by posting an updated version on this page and updating the date below. If we make material changes, we will notify you by email or through the Service at least 30 days before the changes take effect. Your continued use of Sodaroad after any changes constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.
